Sales and Health Contract
/ Shipping Cost / Deposits
All
puppies and adults are as accurately described as possible and are guaranteed to
be healthy and "as we have represented" at the time of the sale. Our dogs and
puppies are priced according to pedigree, quality, and/or possible future
potential. We make no guarantees implied or otherwise that any dog or puppy
sold will gain, or achieve any type of title,
we
do not guarantee Color, size, or future breeding quality or ability in any dog
or puppy sold,
but that they exhibit certain
potential and a possibility of doing so based on our evaluation at the time of
the sale.
DEPOSITS:
A non-refundable deposit of 1/2 the purchase price will hold the
puppy of your choice for 30 days or (until puppy is ready for placement), so
that health certificates, final payment, shipping and/or transportation
arrangements can be made. After 30 days, a boarding, and maintenance fee of
$9.50 per day will be added to the sale price unless other arrangements have
been made, and must be paid before, the adult or puppy is transported from our
home or placed in its new home.
When reserving unborn puppies, a $450.00 non-refundable deposit
will be required. That deposit will beapplied toward the
purchase of a future puppy, and allow buyer a choice of puppy (s) before they
are publicly advertised. The deposit will not be refunded for
puppies due to buyer cancellation.
Two
Year Hereditary Genetic Guarantee:
We reserve the right to
retain or limit the registry on any puppy. If the puppy you purchase develops a
hereditary or genetic problem, which is untreatable, and life threatening and within Two Years, the amount of the purchase price
will be applied
toward the purchase of another puppy or adult. This is a Replacement
Guarantee only. The puppy in question will be
returned to Kyrie Achates
at the buyer’s expense and the health problem confirmed by Kyrie Achates
Veterinarian. The replacement will be made with the next available puppy
of comparable quality and is at the discretion of Kyrie Achates.
Buyer must sign and return health contract to seller before or at the time of
delivery of the puppy or dog or all guarantees are canceled.
Non Refundable
Deposit /Guarantee:
If a deposit is placed for a puppy and a puppy is not born within
one year of placing a deposit, you may receive a full refund of your deposit.
If a puppy is born, and refused. the deposit is non-refundable. If you
purchase a puppy from us. The sale is final. There is no refund.
Placement:
Puppies are placed in their new homes at
10
weeks of age or older.
We do this for the health and socialization of the puppy and we find that it
helps to insure a healthy start in their new homes. They will have had all
veterinarian recommended vaccines, and the puppy will have been de-wormed every
two weeks from the date of its birth. At the time of placement in its new home
the puppy or adult will be eating a Premium Puppy or Adult Food. We ask that a
veterinarian see each puppy or adult as recommended for their age group, and /
or at least annually for adult. We also ask that each puppy or adult be
maintained on recommended vaccine and heartworm and flea preventive schedules and exams
to insure proper health for the life of their puppy or adult.
Placement 72 hour Health Guarantee:
Any puppy leaving
Kyrie Achates will be healthy and have been
checked by our vet and issued a health certificate before shipping via any
airline. We de-worm our puppies every two weeks and before leaving our
home. We take every precaution to insure the safety and health of all of
our animals, but because we have no control over the animal once it leaves our
home,
Kyrie Achates
accepts
no responsibility for death or illness of animals which may be caused by/ or as
a direct result of shipping or exposure to other animals and environments. For
puppies shipped by air, we do insure each puppy with the shipping airline at his
or her maximum allowable amount for loss during or because of an accident during
shipping. We do not accept any liability
for any loss or injury as result of shipping, environment, mishandling, neglect,
etc.. We do guarantee the general health of
the puppy for 72 hours after purchase and shipment for any non-related
shipping illnesses, and a veterinarian must see the puppy within 72 hours
after shipment or purchase. If the puppy dies or becomes sick from an illness
not related to its travel or exposure to outside environments and /or animals
within the 72 hour guarantee time,
Kyrie Achates
will
replace the puppy or adult there will be no refunds.
The sick puppy or adult must be returned to
Kyrie Achates
at the expense of the buyer and the illness or cause of death will have to be
confirmed by our veterinarian, State, or USDA Veterinarian Lab. Any claims
as a result of this guarantee must be made within the 72 hour time period,
accompanied by a Licensed veterinarian statement which our vet can verify.
We reserve the right to have the puppy examined by our own vet or one of our
choice and to confirm the illness or cause of death. This guarantee does
not cover well puppy visits or any type of exam, regular vaccines, de-worming,
any parasites, parasite control or prevention, or any veterinary care, treatment
or medication cost. It does not cover illnesses or injuries, which are a result
of travel, food, water, or environmental changes or exposure.
Any legal filings by the buyer must be filed in the Jurisdiction of Kyrie
Achates and the buyer will be responsible for all legal and
personal expenses incurred by
Kyrie Achates
in any case filed by the buyer that is ruled in the favor of Kyrie Achates
or any case which is dismissed by the court system or where Kyrie Achates is
found not liable. Liability shall be limited to the original cost of
the puppy. An
additional $5,000.00 will be
paid to
Kyrie Achates
for
expenses and time involved for such suits if ruling is in the favor of Kyrie
Achates
.
SHIPPING / TRANSPORTATION CHARGES: We ship as a courtesy to our clients.
You may pick up your puppy here at our hoe if you like. All shipping costs are the responsibility of
the buyer, along with any costs for special health requirements.
The
all-inclusive cost for shipping any puppy within the continental US is
$ 350.00.
This includes insurance from the airline covering loss during shipping,
and it will be for the maximum amount allowed by the airline or the cost of the
puppy minus shipping charges, standard State Veterinary Certificate of Health,
and health exam, which will be issued with every animal shipped with the
airlines. NO EXCEPTIONS.
This price is all inclusive of shipping cost, but is limited to direct shipping
flight cost, Shipping crates which meet Airline and USDA requirements, mats/
bedding, bowls, toys, and labels for shipping are included as well. (Any
additional shipping cost incurred by the buyer other than those listed
specifically above are the responsibility of the Buyer. Boarding cost are
not included and Buyer must pick up their dog or puppy at the destination
airport or they must make arrangements of their own for the dog or puppy's pick
up.) Please take the time to check your state's animal importation
requirements by going to the USDA site
HERE. We must adhere to the
requirements of each state. (Actual shipping or importation requirements will
be the sole responsibility of the buyer). Total Shipping Cost are by
commercial airlines to major airports and are for puppies.
Puppy packs, Puppy food samples, and health related information that we have on
your puppy will be passed along to you at the time of sale. ALL AKC
registration papers, will be sent to you by US Mail or given to you in person if
you pick up your puppy or as soon as they are received from AKC, and the health
contract signed and returned to Kyrie Achates.. If this is a pet/ companion
purchase we ask that the pet be spayed or neutered and we will limit the
registry for a pet purchase. If you are wanting a breeding or show quality
puppy or adult please discuss this with us. We encourage responsible breeding
practices, and will make every effort to assist you in finding the right puppy.
If we find that a buyer or third party for or from the original buyer is
breeding a puppy or adult purchased as a pet from
Kyrie Achates
, whether it be registered with
AKC or another registry, or as a unregistered puppy or dog we will file suit
for damages against the original buyer for the amount of $5,000.00 US. per adult
or puppy sold to the buyer which is being used for breeding purposes and for
each puppy produced by a
Kyrie Achates
Pet Puppy, plus any and all
legal expenses and fees incurred by
Kyrie Achates
or its designees. We do this to encourage responsible pet ownership and
breeding practices, and to insure the integrity of the breed as well as for the
health and well being of your pet, and prevent pet overpopulation. By spaying
and / or neutering your pet you promote his or her good health and prevent
unwanted pregnancies and unwanted pets. We encourage everyone with a
Kyrie Achates
Puppy to attend local obedience classes and shows to enrich the lives of both
puppy and owner.
If you have questions regarding any of these terms and/or conditions please
contact us before you purchase a puppy or adult. We will make every effort to
accommodate you and your needs, but please do not ask us to compromise our
ethics or the integrity of our breed.

Contract for the purchase of a Shih Tzu (Male / Female Puppy) Named Kyrie
Achates________________________________________. I am purchasing this puppy
with FULL / LIMITED AKC Registration and intend to show this puppy if it appears
to have show potential at its maturity. I understand that this puppy or adult
can NEVER be turned into a shelter, rescue organization, or
unqualified home, and if circumstances require a new home for my new puppy or
adult I will contact
Kyrie Achates
so that they can provide assistance in finding a secure and safe home.
Seller guarantees this
dog to be free of serious, life-threatening genetic congenital conditions, i.e. serious
heart murmur, severe hip & elbow dysplasia, and pathological spinal disorder. If
any such condition is found it must be reported to Kyrie Achates within 24
hours, and validated in writing from a licensed
veterinarian and substantiated by lab tests and/or x-rays, puppy may be returned
to Seller at buyer expense for a replacement
puppy. All vaccine records, health records and veterinary records must be sent
to Kyrie Achates, along with all AKC Records and Registration. This is a
replacement guarantee only. Minor, breed related, and treatable or correctable
conditions, or any condition which could go away or is considered to be non-life
threatening or a condition which a puppy will likely outgrow are not guaranteed. Buyer(s) is
responsible for veterinary bills incurred prior to return, and transportation cost to
return. This guarantee is in effect until puppy reaches
Two Years of age.
The buyer must have his or her signature witnessed and guarantee form stamped by
a Notary of public on the date of their signature.
This contract is null and void if the seller
does not sign the guarantee agreement, and if his or her signature is not
witnessed and dated by a Notary of Public, and if it is not returned to the seller with the buyers
signature within 5 business days. The buyer must retain a copy of this contract and keep it in their
possession. AKC registration papers will be given to the buyer upon receipt of
the signed contract. I / We understand that if the signed contract is not
returned to the Seller the Health contract is null and void and all AKC
registration will be withheld and/or registration will be limited with AKC.
Although a
concentrated effort is made by Seller to breed sound, healthy puppies, Buyer(s)
should understand that, due to the nature of certain breeds they are predisposed
to certain medical anomalies, and that any one dog or puppy may have one or more
of these conditions during its lifetime. The Buyer(s) are urged to research the
breed and be familiar with all the health issues that could affect their dog or
puppy before entering into this or any agreement to purchase a dog or puppy.
